Parcel Map WaiversThe California Subdivision Map Act (Map Act) governs the subdivision of land in California. Section 66428 (b) of the Map Act is an ordinance by which a local jurisdiction may provide a procedure for filing a map waiver request. The requirement for a Parcel Map can be waived pursuant to Ventura County Subdivision Ordinance Section 8202-3. However, before waiving a Parcel Map, the County must make specified findings, including, but not limited to, a finding that the proposed "subdivision" complies with the Map Act and to any local subdivision ordinance, and the subdivision meets the requirements relating to improvement and design, floodwater drainage control, public road improvements, sanitary disposal facilities, water supply, availability, and environmental protection.The County of Ventura processes six different types of Parcel Map Waivers, each with their own distinct and often complex exemption criteria: Ministerial Lot Line Adjustment, Discretionary Lot Line Adjustment, Ministerial Voluntary Merger, Discretionary Voluntary Merger, Conservation Subdivision and Large Lot Subdivision. Anyone considering a Parcel Map Waiver application should contact Debbie Morrisset at (805) 654-3635 or come to the County of Ventura Public Counter between the hours of 3:00 to 4:00 p.m., Monday through Thursday, to determine whether a proposed project qualifies for a Parcel Map Waiver and to review the required application materials with Debbie. The following are the most commonly processed waivers:Lot Line Adjustment - A discretionary or ministerial application that alters the property lines between four or fewer existing adjoining parcels, taking land from one parcel and adding it to an adjacent parcel without increasing or decreasing the number of parcels. Consecutive processing of adjacent parcels by the same owners is not permitted; the four counts would be exceeded. Please design and plan accordingly. Voluntary Merger -A discretionary or ministerial process that merges two or more adjoining legal or illegal lots into a single legal lot. Large Lot Subdivision - Subdivisions which create no more than four lots, including any remainder parcel, each of which has a gross area of at least 40 acres and meets findings specified in the County Subdivision Ordinance. |
